Collaborative Law is a method of getting divorce in which spouses agree that they will not go to court to resolve their disputes. Instead, they assemble a collaborative team of professionals to assist them in coming up with their parenting plan and divorce agreement.
A collaborative team typically consists of two collaboratively trained attorneys, one for each spouse. Often teams also include a divorce coach and a financial neutral.
The divorce coach has a background in mental health and is there to help guide the couple through the process. A coach has a different set of skills than an attorney and can prevent emotional or communication roadblocks in the process.
The financial neutral acts as a clearinghouse for financial information, gathering statements, creating balance sheet, running support calculations and helping the parties to evaluate their financial options together.
Collaborative Divorces take place over a series of team meetings. These occur in private offices or on Zoom, not in court. The Collaborative team will help the parties to identify their goals and concerns, gather and exchange information, and negotiate a solution that works for both parties.
